Good luck proving anything. If it was a stand-up dealer, they would replace the engine of their own accord. How well do you know this dealer? Something this insanely stupid is extremely rare, thankfully, in fact this is the first time I've ever heard of someone forgetting to toghten the drain plug on the oil pan (!!)

It's not the first time I've seen it on this board. The other time resulted in the same story -- destroyed engine.

If the engine is oil starved, it only takes a short time (i.e. seconds) to cause SERIOUS damage, esp at 4500 rpm. Anyone who forgets to torque the oil pan drain plug should be immediately fired for being an incompetent moron. I would raise all kinds of hell, but then again that's why I don't let those high school drop-ous anywhere near my car.

Jack Ellena says that if the damage is caused by the rod then they can comp it. If it was caused by a valve or something dropping onto the piston then I pay. Does this make sense to you? He said that if it was a valve dropping it was not related to the oil loss. If it was a rod then it is related to the oil loss. does this sound correct?

That is why I don't let anyone else do the maintance on the S. To me that is part of the ownership.
Sorry about your story. Not the first time I have read this kind of thing on here.

Good luck.

Its all well and good stating all these facts...I had a similar problem as in the end what i couldnt do as i hope that you might be able to do is prove those theory's or get them to admit liability in writing....

Either way hope you get it sorted....
