From the little I've read, insurance policies generally consider a 24-hour period to be one occurrence, thus they felt their liability was limited to $3.5 billion. That wasn't enough to rebuild, so Silverstein argued that there were two separate attacks.

If I understand correctly, the coverage had been negotiated and agreed on, but the policies hadn't been issued yet when the attacks occurred. If true, this has to have complicated matters even more.
