Default HELP !

so i was driving in the middle of the freeway last night with my dad after i instaled my berk testpipe and outta no where wow a cone !! BOW !! hit it at about 70 on the 5 S right before the 8 connecter right after clairemont dr exit... WTF ! i think it is a caltrans cone can i get at the city for this being a road hazard !! ???? HELP !!!

i dont think that cal trans will be held responsible for that. that what i think though. a cone from cal trans is just like any other debris like peices of wood from a truck or a bag of laundry from a random van or something.

good luck on everything though. hope the cone didn't damage the s too much

wow sorry to hear that Jason. dont' think u can take it up with the cone company...maybe u can take it up with the city? I dunno how to go about that tho.

might be able to take it up with caltrans depending on how u present the case. not sure how the process works, but i knew of someone who hit a cone on the freeway and took the claim to caltrans. (his lip cracked and i think the bumper was partially cracked).

don't think you can take it up with the city for that though. hitting debris that cause damage to your car can be claimed on your insurance, but i heard if the object isn't flying through the air and is just laying there on the ground, you should be able to avoid it.

heck i'm still waiting on the city to get back to me about the potholes that bent my rim which they filled up about a week after my claim.

yeah but wouldn't the city be responsible for their construction contractors leaving materials on the highway? It's not the same thing as random junk being left on the road. That's negligence on their part i would think.

I doubt caltrans will do anything, they can say it wasn't their cone and their employees didn't put it there. Or they can say someone probably stole the cone and accidentally dropped it in the road. Caltrans is a very difficult entity to get anything out of.

insurance won't cover it, like lilazgrl said, because it was in the road and you failed to avoid it. Like she said, an object has to fall directly off something (car ahead, tree, bridge) to get coverage under comprehensive coverage.

I have seen one or two friends get lucky and get money for tires when potholes and such were never fixed by their homes, but that is it.

u could start by finding out if there was any construction work done in the area where the cone was encountered.
