Smile s2kmugen - Damaged Hardtop

Entire story is here: https://www.s2ki.com/forums/index.ph...&f=53&t=663558

Cliff notes:
Purchased hardtop from John August 08'
Item arrived damaged with two corners of CF chipped off
UPS Claim was initiated the same day (package was insured)
Hardtop taken to body shop for repair ($500)
Requested John for reimbursement of repairs due to inadequate packaging
No response and/or lack or response till January 09'
John notified me that claim was denied last week
I requested status from UPS and was told that the claim was voided Nov 08'

He refuses to reimburse me as he feels that he is not responsible. I am asking to split our losses in half and cover for $250 only. I believe this is fair for both sides and waiting for resolution. The shipper is liable to deliver the package as described. UPS claim was initiated between the Shipper and UPS. I am contractually not involved in the claim as I'm merely a 3rd party.

Believe the claim was denied due to packaging requirements. This was a Seibon CF hardtop.

5 months and still waiting resolution.....
