I would like to first say that I have been on S2ki since 2002. My user name does not reflect that since I was deleted during the big site change over. My old username was Marty J n' S2k. I have been buying and selling items on here the entire time I have been here and have never had one problem.

A little background on this matter first I feel is needed. I met Sbrodacz (Seth) back in the fall of 2008. He was wanting to trade his T1r Sparrow for a 3 in single as he was turbo. At that time I was wanting to go back to NA and turn my car into a more track oriented car. I went over to Seth's house to do the trade. I took his exhaust off his car and installed my UR single on his. From that time we stayed in contact on a regular basis. We discussed our builds and shared ideas. Seth would ask me technical questions with the install and about certain parts which I had no problems helping out. Fast forward to July of 09. Seth was selling his IP kit to upgrade to a tubular set up. He found a buyer but needed an intercooler to sell with the kit. He called me up as he knew I had an intercooler laying around. It happened to be right around the time I was leaving the country for a few weeks. I had no time to drive the intercooler up to him nor was he able to make it down to me for some reason. He really needed the intercooler to go with the kit as the guy buying his kit did not want to wait till I made it back in town. Seth suggested that the buyer of his kit would just drive down to my house to pick the intercooler up himself. I agreed and had no problem with that. I was in contact with Seth on regular basis and took him as a legitimate person so I was not worried. Seth said he would just mail a check to me so I would have it upon my return. Well I never received anything and asked for another check to be sent out. This turned into a big ordeal with checks constantly being lost somehow. I have never had any sort of problems with the mail before. Then it turned into him having financial troubles. His financials troubles do not concern me as we made a deal. By the way it is December at this point, the intercooler was sold to him in July. Again I was more then understanding and willing to continue to wait. I was giving him the benefit of the doubt the entire time. Recently I saw Seth post on S2ki about buying new parts, getting insurance put on his car, new tune, and filling up his car at $6.50 a gallon. This got me a bit upset as he can afford to pay for all this but is unable to come up with my $150 for the past eight months. I made another attempt to contact him trying to find out what the deal was. Well this was the last straw as he made some rude and ignorant comments towards me that were completely uncalled for. Then he sat there telling me that I have been throwing his checks out! Why on Gods earth would I do that? Reading through all our text messages and how he has been handling this situation I feel that he had no intentions of paying me from the start. As he avoided my questions about the money several times. He is a liar and a thief in my eyes. I will let everyone decide for themselves though. I have all the text messages him and I have exchanged. I took the time to take screen shots of my iphone for everyone to see. Read through these texts and decide for yourself.

*I do understand I should have never given the intercooler up without having the money first. I was dumb for trusting him but like I stated earlier we were in contact on a regular basis. He really needed it and I had no problem helping a fellow S2ki member out. I learned the hard way, which is sad because it just goes to prove that no matter what no one can be trusted these days.*

After reading through that. What do you guys think of this situation? What can be done at this point?

 

The situation? The bank statements are saying you cashed the check.... Not my fault your a moron and kept throwing the check out making me send 3 of them to you. It is too bad you cannot post the phone conversations. Then the real truth would come out. This would be real good for a law suit.... MHM I may actually do that. I'll bring the statements over to the court house.

 

wow i bought injectors from him a while ago with no issue. Seth threatening to sue is still a threat, calling him a pollock isn't going to help your case. On numerous times he requested politely for the agreed money.

There were two sides to the deal, which i'm sure was either verbal or written. There was satisfaction on the buyers behalf but know consideration for the seller. As per the law, a court would see that the amount of time taken to send the money was unreasonable. I'm not a lawyer or law expert, but i think its pretty clear.

YOU CAN'T AGREE TO BUY SOMETHING AND NOT PAY! Also if you can't send $150 dollars you better not be driving period and eating from the trash

 

Good grief guys......I'm not about to get in the middle of this but you need to get things resolved.

 

No offense, but you only know what he has posted. Like I have already stated that he was paid he was paid a long time ago. I have statements from the bank showing he cashed the check. What he is doing is slander. It is the exact definition of slander and I'm sick of dealing with this. This is why I will be filing a law suit tomorrow. Given that I have a statement showing he cashed the check and now have these threads showing he knows he is lying but is bad mouthing me it will be a quick day in court for me.

 

Chad it's been resolved. He was paid months ago....

 

I am looking forward to the court date Seth. I just got off the phone with my bank just to make I am not crazy and missed something. I try to be as understanding as possible. Guess what the customer service lady at Charter One told me...No checks deposited in the amount of $150 from July 2009 to present time. So please bring your statements to court as I will bring mine as well. I will be glad for you to cover the initial court fees, and I will counter sue so I might finally get my money.

 

You do have a point, each story has two sides, but in my opinion $150 is not worth a lawsuit.

 

I have nothing to prove here. I'm not the one creating threads and posting on others threads to bash someone. I will leave it up to the courts and not members on s2ki to decide what is the truth. What you can do is check Lake County Illinois circuit court and following along with the progress of the law suit.

 

are you both from illinios? if not im almost certain they can't rule over interstate commerce.
