Default Need some legal help here

I purchased a set of Mugen rims from RDMotorsports which is an authorized Mugen distributor. I have paid in full in May 12th, 2003 and David from RD promised the rims would be deliveried to me by the end of August. After tbree months of waiting I didnt get my rims so I phoned RD at the end of August and I was told there was a small delay. I understood things like that were beyond david's control, so I accepted the execuse and kept on waiting.

I waited ANOTHER two months (Mid Oct, 2003) and I still didnt receive the rims, I called RD and David told me the rims were shipped out already. I asked for the tracking number, david told me those rims are shipped thru USPS ground and they dont offer any tracking service. (One of the mods helped me check with USPS, and it turned out USPS does offer tracking serive) I took his words for it and waited another two months.

In the beginning of Dec, I still didnt receive me rims, and I became very frustrated. I called RD and asked David what was happening. He told me the rims were shipped out and he would help me look for them thru USPS. He finally gave me two label number from USPS:

PS from 2976-A
Label # CP129105257US (doesnt even work)
CP127951705US (item left NC(? RD is lcoated in SC) on Oct
11th, 2003)

from 4042 Ashley Phosphate Rd,
Charleston, SC 29418

I checked the CP # at www.usps.com and one of them doesnt even work, so once again I called RD trying to figure out what was happening.

David asked me to contact Canada Custom and find out if my rims were stuck there. I went to Custom 3 times and everytime i got the same answer---USPS as the original shipping company needs to locate the items, there is nothing Canada Custom can do. RD as the original sender has the responsibility to locate the rims for the receiver/customer.

I emailed David and let him know what I was told, (this was back in December) I havent received anything from David ever since that. I called David earlier today and asked him if there is any update from USPS, he told me Gary, the customer service manager from USPS asked me to push my end more (jeez i wonder what i have been doing)

I have waited 8 months and I have always kept my calm and tried to communicate in a respectful tone, but enough is enough. I have been to Custom three times, and I annoyed the hell out of the staff there, if anything could be done in my end, I have done it already. I didnt get the rims I bought, I got hella nightmare!

I bought from RD before and the transaction was great, it was the reason I decided to buy from them again, but now it seems to me they are not helping at all. I had to bug David every second week to ask for updates. David has been constantly saying he would get more info from USPS but he never gave me a good reply on the current situation. I feel I am getting screwed and I don't know what to do. I have talked to one of the mods about it and he sugguested me to get more advice from site. What i want to ask is

Am I justified to ask for a refund at this point?

I mean its after 8 months of waiting and nobody can locate the rims.

I am sorry for the long post but I am really in need for some help, any input would be much appreciated.

Um yeah, after 8 months you're pretty much entitled to do whatever you want.

Since RD isn't a sponsor of this board though and I've never seen them here I'm wondering why you posted it in Site Info?

Ah OK. Used to be...but we can't do anything about it now. Maybe they should have stopped shipping to CA too?

How did you pay? If by credit card, they are your best friends with this.

They represent you, not them and they may be able to void the original transaction with proper documentation showing that the stuff never arrived.

Actually, you don't need documentation. The vendor must prove that it was delivered not the other way around. Call the CC company and tell them you didn't get your stuff.

I paid by money order

I wish I purchased it with my CC, then I would have disputed the charge by now. I think my only option left is to get a lawyor but then again the rims are probabily not worth the lawyor fee.

I understand RD is no more a site sponsor and there isnt much you guys can do, I am simply asking for some personal advices. Thanks
