Does the stock heat shield bolts on to the Berk header? Are you going to be at Aerosim this weekend?

No, you shouldn't get one. The only ones to worry about are 06-07+

On some cars its proven not to, but on others it does, its really a tossup.

That's very odd, that some get CEL's while others don't.

Buy it, try it, if you get a CEL you can sell it for the same price. That's the beauty of buying used parts
