If you are not actively attempting to take business away from them by making false statements without evidence I dont see how this would have ANY merit. Its as silly as sueing a movie critic because they went on their show and said the movie sucked. We have the right to what we say, and if we disagree with how a service was performed we are able to express it in a reasonable fashion.
There seems nothing unreasonable about this too me. Work was shoddy, when given a chance to make right the company dropped the ball. IMHO, they got nothin........

But do I want to take the chance of them actually attempting to take it to court? Do I want to waste the time that it would take?
Yes, to a limit. I really do not want a summons to court, even if I know im going to win.
At the same time, I also do not want someone telling me what pictures I can take of my own yard. Whats next, telling me my dogs cannot run near the fence in the yard because it might make them look bad?

I would upload that audio file to the same website or link it some where. Tag it "Tri County Fence Customer Service Follow up" LOL and again upload more pictures... like "My Fence in Late Summer" 
They would hate me... of course I'd actually get sued and loose.
