Default First Run-in in Houston

So I just moved here from Austin about 3 weeks ago. Today I was lucky enough to personally meet one of Houston's finest.

It was about 7:30 this morning around Houston and Washington. I am driving well within the speed limit when a cop passes me going the other direction. He decides to pull a u-turn and pull me over. He gave me a citation for 1.) No license plate in front, 2.) Having a clear plastic license plate cover, 3.) Expired Vehicle Registration sticker.

I know the Vehicle Registration sticker is my fault , I let him know that I tried having it renewed but since I moved I would have to register my car in Harris county rather than Travis county where I had already submitted payment but received a letter stating that I could not.

So in conclusion, does anybody have an idea of how much violations 1 and 2 are going to cost??? I know that if I get my car registered within 10 days the penalty for violation 3 will only be $10.

Also, any thoughts on how to mount the front license plate without taking out the plugs that I have for the bracket holder??? I know that there was some mention about a bill just passing not requiring a front license plate, when does that take effect? I have lived in Texas since 2002 and have never had a front license plate and have never had an issue prior to today.

Also, can someone provide additional information about having a clear plastic license plate cover on??? It is a basic clear plastic cover, no tinting, no ridges, no light deflectors.

To say the least, this guy was definitely going to write me up for some type of violation and there was no way that I was going to get out of it. Maybe being the last day of the month had something to do with it.

First off, welcome to Houston! Sorry about the HPD greeting.

The main HPD station and the courthouses are located 1 block south of Washington and Houston, so you were in enemy territory. The police chief has also enacted a policy where every cop must issue 1 ticket per day. So we are all going to have a chance to meet one of Houston's finest for even the smallest infraction. A jaywalking task force was recently implemented in downtown Houston, so even pedestrians aren't immune to this harassment.

I know the the city of Houston has a website that you can verify what the fines are going to be for each violation. It should be on the back of your ticket.

There's a lot of confusion surrounding S.B. No. 439 which adds new restrictions regarding visibility of Texas license plates. (7) has a coating, covering, or protective material that:

(B) alters or obscures the letters or numbers on the plate, the color of the plate, or another original design feature of the plate.

Questions this raises:
"interferes with the readability of... the name of the state" If the license plate frame slightly covers the name of the state but "Texas" is still clearly recognizable, is that against the law?

"original design feature of the plate If some decorative elements (such as the fringe of artwork that includes the space shuttle, moon, and oil wells in the corners of some plates) are partially covered but the actual license plate number and the state are clearly readable, is that a violation of this law? Inquiring minds want to know...

PubliusTX.Net Weblog proclaims "License Plate Brackets Are Now Illegal" with a sarcastic take on the new law. Readers respond with their own yays and nays, clarifications, and questions. One concern is that this new law is simply a way to make it easier to pull over drivers to "carry out drug searches, to check sobriety, and the like."

The Texas Department of Public Safety focuses more on the lighting aspects of the law changes, stating (emphasis theirs) ...subjectively (or in the eyes of the law enforcement person), all illuminated license plate frames - especially the neon ones, are NOT LEGAL.

So Ulrich, if I read your response correctly, (btw, thanks for all of the great info) if I have a clear plastic license plate cover that does not

then there should be no reason for the officer to have written the ticket, is that correct?

The law states that if it obscures or in any way deters clear viewing of the license would be justification for a violation.

After reading the entire law in detail, a part of me wants to fight this ticket, especially if it is going to cost me $200. I tried to find out the amount of the tickets, (thanks joe_s2k) but these violations are not listed either on the site or on the back of the ticket. I will not be able to check the violation costs online until the officer submits the ticket to the courts, which they say can take either 1 day up to a week.

I found out from a co-worker that the missing license plate in front will cost about $90 for the first offense and that it progressively gets higher if you are citated again.

Words will not be able to express my frustration or anger if this ends up costing $300.

Yes, but I guess it is up to the officer's discretion whether he thinks he can read the plate or not (how's that for ambiguity?). It's that "coating/covering" paragraph that might cause some trouble. If you think you have a case, go fight it. Thay can't fine you any more money just becaue you contest the ticket, can they?

Take pictures (from different angles), take a print-out of the exact wording of the law to court, and read up on the discussion at Snopes.com about the spirit of the law and what the legislature was trying to achieve in passing the law. All that should give you a good enough argument.

That law did not pass both house and senate, I thought, and therefore is not in force, yet.
