Default HELP! Pulled over and told "100mph"!

Got my S2K on Monday and just run her in today! Went out with my mate this evening when he came round for dinner. Only 10 miles or so with the roof down! Came out a corner on deserted A road just west of Aberdeen and nailed it in third. I passed a car sitting in a farm road on the left, looked at the speedo

Unfortunately it's your word against the police officers' so you'll probably have to grin and bear it.

What evidence did they show you? Was it just the reading or a picture taken with it of your car or??????

Normally these sort of things are rarely 100mph and besides if you were in third, third doesn't reach 100mph, are you sure you were in this gear?

I am not questioning the honesty of your statement here, but trying to get you to systematically analyse the moments when it happened to re-inforce your memory. Making some notes as you go along will help you in the future as well I am sure.

But it may come down to the "What the police says goes" brigade.

I think we need more info to help mate

Sounds like a pair of bored cops. AFAIK if there was 2 officers in the car they don't even need radar evidence, their word alone is enough evidence as they are considered 'experts'. Like you say it's very odd that it was exactly 100mph - most likely scenario is you caught them unawares and they didn't get a reading, so they rigged it.

There were 2 Officers and they did show me the radar and it said "100"

No consolation, but as far as the *your* speedo goes, the "S" speedo seems to read about 5% over according to the GPS figures I've obtained in two cars, so you would have had to have seen 105-plus for them to have clocked you at 100. Even in the thrill of a newly run in "S", I'm sure you would have noticed the magic three figures.

Unfortunately, up against two "busies", your word means little! .....But then I'm probably biased, since my first speeding offence was being done (literally) by a copper estimating my speed at 48mph. I was on a bicycle, he was stationery and had no measuring device..... Guess who the court believed!

[O.T. Just discovered that the spell checker doesn't like the contraction of: "I am", nor the abbreviation: "mph".]

There is precedent here though. People have been clocked at speeds there car wasn't capable of and got off. In your case that is clearly not the case, your best bet would be to challenge it, go to court admit to the speed you were doing but maintain you were not doing 100 mph. If you have a witness (albeit tainted) it isn't going to hurt.

You are then at the mercy of the Magistrate. but if it isn't true then there evidence will be a bit shaky.

The law says you only need the opinion of one police officer for a conviction IIRC however pragmatically they do back it up with evidence, but as far as I read it (and I'm not a lawyer) they are not actually REQUIRED to prove it under the road traffic act

your best bet IMHO is to turn up cap in hand and state your case as clearly as possible, hopefully the lack of proper evidence will throw the Magistratee in your direction.

It would help if you could clarify exactly what happened st the end of all this.

Did they issue you with any documentation, caution you, tell you what was going to happen next etc?

What is your problem with what they said to you?

Hardly sounds like a Rodney King incident.

Dunno about the location of the Police car but it's always possible that they managed to sight the gun wrong.

My God Father was looking for his hat that had blown off earlier in the day so was doing about 10 mph down this country road and got pulled for doing about 80mph

The cops had the gun sighted through some trees and the flickering effect of the car passing past the trees was somehow confusing the gun. Fortunately he's a Technician at Manchester university and he got one of the Professors in as an expert witness to prove how the gun worked and prove the police wrong.

Something worth considering but I don't know if it will help you out. Good luck.
