HELP! Pulled over and told "100mph"!

I did get read my rights but I didn't receive a ticket or have to sign a statement or anything. I didn't a get an NIP - please tell?

My issue is a I wasn't driving fast or dangerously. I had the car for 5 days, it had just turned 630 miles and I decided to open it up (first time!) on a clear stretch of straight road, at night with full beam on. I know the road like the back of my hand - It's 2 miles from my house. I just accelerated in third (for what could only have been seconds) then shifted up to forth and into sixth. When I saw the "blues" I looked at the speedo - 78!

I intended going down the route of momentary burst of acceleration, new car, etc.

Thanks for the advice guys. I'll let you know what happens. Haven't slept since Saturday!

Will I get a ban? I NEED my car for work!

think the assumption is getting caught 30mph over the designated speed limit is a ban...

local guys here near heere got cuaght for doing 138... got sent down for 8months!

do you mean you got a stern talking to or an actual "you don't have to say anything?" Sounds like a wind up as they would tell you what happens next

that's debateable-you said you were doing 78 in a 60. I'm not having a go but sometimes it is worth taking a step back and thinking about things. Copper may have thought you weren't paying attention (ie you hadn't seen him & what would have happened if he had pulled out etc etc).

Maybe it's different in Scotland but down here unless you have your licence and insurance documents with you plus MOT if the car is more than 3 years old you will always get given a "producer" notice which sets out the offence and contains a form to send off with your fine (assuming it's a fixed penalty), but you always get given something.

Is it different up there/ I didn't think we had one Road Traffic Act for England and Wales and another for Scotland.

They just ran a check over the 2-way which comes back with registration and insurance information. Asked for my licence but din't have it.

I did actually get read my rights but got stopped 2 years ago and they did it then too - "you don't have to say anything.....". I think that is farly standard.

It wasn't a laser. It was one of those old speed guns with the red LED display.

Was it radar or laser ?

Radar is quite easy to get a reading from a tuning fork, a sort of secondary test if you will, to make sure the calibration is still true.

still a bit confused here-sorry

so they did read you your rights AND did a radio check but DID NOT charge you with anything specific?

If above is true then you have nothing to worry about

what happened 2 yrs ago?

Am also surprised they have not asked you to produce docs within 7 days?

Whetever the speed device it still needs to be calibrated

hope the above is correct for your sake

They don't actually have to charge you there and then. What they can do is to give you a verbal NIP, simply indicating that they intend to refer the matter on to determine whether a prosecution should be brought (or words to that effect - Tonky can probably tell you whether there his a mandated form of words; I don't think there is, it just needs to be clear that they're preserving their right to take action).

Is that what you mean by having your rights read to you? If they didn't do so there and then, I think they have 14 days to serve an NIP in writing.

that was my point Mark-they have to tell you their intentions. From VtecIT's replies it doesn't sound like they have done this.

Hi,

Just thought i would add my two penniworth here.

1) You say you were not given anything resembling an NIP (notice of intended prosecution). I would expect you to have been given a "producer" at the scene at least, and if the rozzers decided you were going to court there and then you would have been given your NIP there (you werent given a form with your recrorded speed etc or anything resembling a ticket ?). I will wait for Tonk to verify but im pretty sure unless you receive an NIP in the post within 14 days you dont have anything to think about.

EDIT: lots of posts in quick succession here ! - sorry as MT says the police can give you a "verbal" NIP - but they must state their intent to prosecute. Thats what i meant above but i didnt make it very clear, it is after all Monday morning.

2) 99 in a 60 would *not* be a fine and points. Check the guidlines on pepipoo but, remember that to a large extent this is down to the officers discretion as well as the magistrates court. Nonetheless 99 in a 60 is well over the guidlines for a fine. For reference i was caught doing 97.4 in a 70 (unmarked Police Volvo) and i received
