Shafted by Auto Modena
Latest info from Which? Legal Services:
As the money paid to AutoModena was for a deposit, only the commission is their's and the rest is my property. All property is to be returned before liquidation. This means that the balance is not an asset of AutoModena and is not subject to the liquidation process.
The commission is subject to liquidation and consequently we would have to join the queue.
All depends how the liquidator (unknown as yet) approaches it and how many people are in our situation. The fewer, the better.
If the car has been ordered in my name (and not the agents) at least some of the deposit has been secured and I will have a car (unlikely?). If they haven't ordered it at all or ordered it in their own name then I hope Which? are correct.
Interestingly, AutoModena were not the cheapest. After all the background checks, they seemed to be the safest for the money!
PS Pete: don't think I fancy Wales at the moment .....

Maybe 'tetleys' can help you trace your order?
"I have a contact with a dealer in Belgium who will check to see which dealer orders have been placed with by Auto Modena. Theoretically the customer can then take over the order and not lose out. "
Did you pay the deposit with a credit card?
I hear what you say about Wales. Sorry, mate
Pete
Pete - spoke to tetleys, very friendly and helpful. If the car was coming from Belgium they would need your passport details first and they didn't ask for mine or Dumbledores (Matt).
Paid by cheque - very few (if any) importers I spoke to dealt with credit cards because of the charges they had to pay.
As Father Jack (from Father Ted) aptly put it ..... "ARSE!"

If you do get back your deposit, even if it is minus those Bar Steward's' commission, it will not be as bad as it could have been.
And then, when you do buy (direct from a dealer in Europe, presumably) just add on the Auto Modena commission you lost to the overall cost and you will hopefully still have a good deal.

Good luck
Guys,
In situations like this is is great to see the amount of support, assistance and encouragement that is on offer. Yes this is a nightmare, maybe we will get some money back, who know's they may have actually ordered the car which would greatly increase our chances, but I guess the moral of the story is that old saying "Caveat Emptor" - Let the buyer beware. I hope we will not have to put this down to one of life's learning experiences but I'm not that hopeful.
Dogbiscuit and I are really grateful for your help, but please until this bloody mess is over continue to offer any pearls of wisdom you may have.
Thanks again we will keep you updated, if anybody is interested it was anounced on the What Car website today.

What sort of deposit do these folk ask for - all the sites I've seen seem remarkably coy on this.
Presumably it is more than the
