There is absolutly no requirement to prove that the modification caused or contributed to the failure. The Hondacare insurance policy is NOT a warranty. The factory warranty has certain legal protections (like the Magnessun/Moss act) that the Hondacare insurance policy does not afford you.

...And like Keith's issue of diff failing due to some BBS LM's after only 1000 or so miles after it had been 'repaired' by another Honda service shop.

Not to make HondaCare warranty look like it's worth completely nothing....I did get HondaCare to cover some engine repair for my car not so long ago (without having to strip my mods off the car and going back to stock). Even though a situation has worked out favorably for me, I doubt that I'd be buying another HondaCare warranty ever again.

The list for local owners is MUCH longer in favor of getting claims nixed than for those that have had issues covered under HondaCare. I've also noticed more manufacturer's warranty claims being denied more recently, citing driver mis-use rather than due to mods (auto-x, track, etc.).

Yes he is Mike Beesch. Anyways here is the update. They rejected my claim based on my CAI which they claim put excessive stress on my diff, which is absolute bullshit. Now what I am starting to figure out is that the honda "certified" warranty is in fact different than the "hondacare" warranty. I did not buy a warranty, instead my warranty was there when I bought the car for 7 years/100k miles. Does this give me any chance of having it paid for? I am trying to give it every bit of effort I have to make sure I do not pay for this because I feel as though I am being jerked around a lot.

you should ask them to explain how a CAI which is good for maybe 2-3hp (and im being generous here) can put excessive strain on your diff, when there can be a variation of +/- 10hp from a stock to stock S2000 on the dyno - is everyone's diff built car specific???

I had the same problem with my Hondacare. They even said that they agreed that the 18 in aftermarket wheels had nothing to do with the diff failing. But because it was a mod I voided out my warranty. So I was out, and the rear axle that got replaced a month before had nothing to do with it either so I couldn't get anything from the dealer or hondacare.
I agree alot has to do with the dealer and how much they work with the people and hondacare. I had a bunch fixed under hondacare using a Green Bay dealer where I bought the car, and even at that time I had mods on my car, and they knew I tracked it too.
Bringing it down to Racine screwed everything up, and now my car is flagged so it can't be warranted anywhere.

It's called the Magnusson-Moss Warranty Act.

It's illegal for them to cancel out the warranty on a manufacturer's warranty, however, in an optional warranty (like HondaCare), the verbage in the warranty contract states the warranty could be nullified due any reasons arguable by the company.

This owner however is going through some other avenues at this point. I'll let him write about it if/when he gets back on to update the thread.
