Awhile back I posted about a friend and his S2K and how a local Bay Area dealer sold his S2K, before there was a completed deal. (There is no deal)

The place the dealer sold it to supposedly sold it to somebody else I'm sure you all have read my post(s) on this, well... that person was me and it was my S2K.
I was embarrassed to admit it here, to my fellow S2K owners. As I will never, ever let it out of my site if and when I get her back. Now I have no car and my S2K is out there supposedly the wire harness caught fire and burned it up. BS! The dealer should not have sold it to the auction house and the auction house (local) should not have sold it to (most likely another dealer) without a title. My attorney is working on it.

I want it back, it still legally belongs to me, no change in title, the title is in my name and there is no release of title. Nor will there be a change of title. It's mine, and by law it is illegal to sell a car that does not belong to you let alone have no title to. According to the Police and DMV the supposed new owner will not be able register it, and should not be able to retain insurance on it since it

I wish i saw your thread earlier. saw and unidentified S2000 (Silver/Red) at Thomas Fogherty Winery today. No one inside looked familiar. Will keep a look out for Vin#5732 but...

whats the plate number? much easier to check!

I've seen lots of silvers around lately, I'll keep a lookout for it. Don't worry to much buddy.

UGH. This is still going on? I'm sorry.

1st off, no need to be embarrassed around your fellow S2k owners!

It sounds like you already talked to the police and they aren't able to do to much, can they report the car as stolen incase it gets pulled over or something??

How did you pay the down payment? Credit card? Check? unless it was cash, you may be able to get that money back. Contact the credit card company or your bank and get them involved.

Basically cause any ruckus you can with anyone you can to get this dealer to notice you. Yelling and screaming won't, but the might dollar talks.

Otherwise, my advice would be to get an attorney involved at this point... I know an excellent criminal attorney thru a friend, he might be able to recommend someone if you don't know of any.

My advise also is coughup the Dough for a good Lawyer.
It is'nt illegal to dealer trade a car that hasnt cleared titling but it is Iillegal for the trading dealer to sell the car unless title has been cleared by the bank of any outstanding leins. Now Im guessing the fire story is a BS lie to cover up the dealers Fuk up.
They are probably trying to make you not want the car back and keep the one you bought at the higher interest rate. Be patient, I know and have heard many horror stories of corrupt dealers and this sort of thing. Dont be afraid to scream rape at the top of your lungs to any and all who can hear, (i.e. BBB, consumer services, American Honda, even your cities meanest TV troubleshooter.) If your car is still available to the dealer, they will cough it up. If not, drive that peice of hit you bouht from them through the showroom window.

Thanks for the words of encouragement guys; I need all the good cheer I can get at this point. I have an attorney working on this; my attorney and I have asked for the S2K back.

Basically there is no deal, the paperwork and financing never went through, and there has been no release of lien. They basically said it was a go and I received documentation stating otherwise. They cashed a check to cover the tax and license without the deal going through. So I should get that back as well. I already went to the Police and DMV; they both say the title is in my name.

My attorney has formerly asked for the S2K back and they have till mid next week to come up with it or else.


The dealer (sales managers) or whatever knows they made a huge mistake and they were trying to get me in the other car so bad. But with no financing, the dealer never figured I would have returned the car I was trying to buy. I took lots of pictures of it before the returned it and I videotaped the return of the vehicle as I was dropping the keys off at the dealer.

I would not mind riding with somebody if an event or drive is coming up, of course I would buy lunch or dinner and pitch in for gas.

that royally sucks. As passleft said, no need to feel embarassed we all get screwed over like this sometimes. Count my eyes as peeled, and good luck!!

Here is an update...



I found out that the auction house sold it to a local wholesaler and they supposedly sold it to a local retailer ( I believe he said Honda dealer but when I asked him to repeat himself because I could not hear on the cell phone he declined to repeat himself.


I have the attorney working on it.

somebody mentioned that a silver was at one of the wineries. I believe mpovlin on another thread mention they were there.

Hi NorCalS2K.

Sorry this is still unresolved. Can you say what dealer "bought" it from you? I would like to be able to avoid them.

I've got a Silver/Red and live in Redwood City... stock exhaust and perfect seats but otherwise the same as yours. If you don't get it back soon, you can ride with me on the next event I am able to attend.

As soon as I post this reply I'm going to put a post-it with "5732" written on it in my wallet.
