Retrieving the data should require a search warrant if used in a criminal case...just as a warrant would be required to retrieve data from your PC or file cabinet, etc.
Any other purpose should require your permission or a civil discovery subpoena. Sorry...but if your black box shows you were speeding and it was the primary contributor to an accident, then why shouldn't you be held accountable?

When you sign the sales slip, you have already agreed to it rather you read your contract or not. Not their problem that buyers don't read the contract.

Imagine if the device malfunctions or records inaccurate data as the car ages. Who wants to get railroaded by a faulty machine considered infallible by the courts? We all know machines, and computing devices in particular, are more than fallible. There's a reason red-light cameras and photo-radar are constantly struck down by the courts.

You know I can't even imagine ANYONE who wouldn't be upset with having a black box on their car.
There are just too MANY ways for it to be misused and too FEW ways for it to be beneficial.
If it was totally my call as to whether the data could be viewed or used then maybe I could see the a little more benefit, but not much.
But as to the bankrobber/terrorist scenario, unless there is a satelite hookup then a time stamp would be nonexistent or erroneous.
