I am not sure we can ascertain he was driving intentionally on the shoulder. There are many accidents caused by cars being parked on the shoulder. Drivers from behind may think it is just another lane for whatever reasons (low visibility, no emergency flashers/road flares, driver distracted/not paying attention, etc.).
I know I have mistaken the shoulder for a lane at least once before, although I didn't actually get in there. I am sure it has happened to more members, it is not that hard to do especially when someone just pulls over and leaves their tailights on. Be careful out there.
Rumble strip would have given it away. This guy was way over posted limit, in the shoulder, and he knew it.
Not that it matters now but, did you notice the rigs brake lights work but the trailer lights don't? maybe the impact knocked them out , Also - the trailers step/guard is pushed up against the rear trailer tires.
