you will get up to 6 points and ' driving without due care ' and prob a 200 ish fine - thast what i got for somethign similar...
id say that you go ' guilty ' but make sure you have a statment ready to say that you overtook on a road you know well , and there was plenty of space to be safe and witin the speed limilts BUT you could not predict that everyone would spot a police car and stand on there breaks - which forced you to safely continue over the white lines till you could tuck back in .
also mentino that the police were polite and professional but you would like them to accnolige that there ' visibility ' caused the traffic to slow down ( even though people were in the speed limit )

The gist of the original letter was that the guy wanted to know if he was allowed to over take when there were solid white lines, but NOT crossing the solid lines themselves.
Needless to say one of the two police officers said it was legal to overtake so long as you didn't cross the lines, the other disagreed. It's this kind of inconsistency that really pisses me off with current traffic laws. From what Moggy posted the first police officer was right, and the second one would happily have nicked you.

"Even though everyone was already travelling well BELOW the legal speed limit, the current knowledge of you average driver is SO BAD they do not actually know what National Speed Limit is for a B Road and a white circle with a black line through it isn't much help at giving them the correct information.

i was done for crossing a solid white line a few years back, overtakign a slow moving diesel van out of a 30 limit, knew the road and didn't cut the line by much but didn't see the unmarked volvo a few cars back. 3 points and
Some very helpful advice & clarification, not only for our friend but in response to my experience (I didn't wish to distract from the original subject).
Re-reading all the postings has got me to consider re-thinking EVERY time I want to overtake. Easily said as I sit here at the keyboard.
Can I wait just a bit to be sure? - I remember there used to be a safety advert. IF IN DOUBT -HOLD BACK.
Is it really worth overtaking - will I gain any extra time?
Only this morning a Bently Continental came steaming by me & 15 minutes later I was behind him as he had had to wait for ever at a busy junction.
Just because I'm in a sports car I don't have to rush everywhere.
Most times I want to get by a poorly driven car whose driver is obviously not concentrating or generally dithering & I consider him ( more times a her - sorry but true) a moving hazard that causes me extra stress as I work extra hard attempting to anticipate the next stupid move.
In an open car I don't like getting stuck behind big lorries due to the stink of diesel, & the heightened chance of something big and heavy being thrown up from the wheels.
Constantly thinking LICENCE / FINE seems to help - well er so far that is.
