Default Exhaust Valve on BMW 330 (O/T)

Just sat in traffic behind the 330 Ci and noticed that there is a small valve in the right (of the twin pipes) exhaust.

When the car was still the valve opened....as soon as it moved forward the valve closed.

Quite sad but I was mesmerized

What does it do?? Anybody??

I think the valve may be operated by vacuum from the inlet plenum. It is only there so that it effectively shuts off 50% of the exhaust, thus allowing the car to pass the 'drive by' noise limits set by government.
