True - but ask yourself why it was considered uneconomical to repair it in the first place, which is what leads to it being listed as a Cat D. If the damage was that light, chances are it would have been economical to repair it - unless the car is worth bugger all to begin with. But that's unlikely to be the car with the BMW in question, is it?

But if the car is nicked, not found, insurance pay out then the car is found.

Doesn't that then register it - or am I going mad?

You're right but being a bit pedantic, it's still a write-off - the insurance declared it a total loss and paid out. That's how it ends up being categorised. It's quite rare for a car to be given a CAT D without significant damage.

If it's a stolen recovered I'd try and find out if it was damaged when recovered (there's always a possibilty it was pranged and abandonded). My brother bought a bargain 206 GTI that had been stolen/ recovered and it turned out to be a very good buy for him (didn't lose any money on it in about 2 years!).

Cheers, its worth 15,000 and he was offered 12,000 in px so that seems fair.
