Default Speeding ticket

Just got a speeding ticket through the post, doing 36 mph in a 30 mph

Can I ask for video evidence as I go down this road twice a day and never speed, they are prob right of course but would like to see it?

It isn't video

Unless you were followed by a traffic car

But you are entitled to see the still photos

Any idea what type of camera it was ?

Also check the date on the NIP in relation to the date of offence

It must be served within 14 days (unless the offence is in relation to an "accident")

It would have been in an unmarked van, sneeky gits, so a mobile one I guess.

It may well be video evidence in that case

I assumed you were referring to a static, permanent roadside camera when you stated you regularly drove along that road

But, in any case, you are entitled to see the evidence

Jamie - you don't automatically get offered the course. Humberside Police run this course and I tend to find that my drivers only get offered it if it's a first offence however depending on the speed it hasn't been offered at all, even if first offence.

Definitely request photographic evidence and check dates and times.

Normally you get offered the 'course' if you are caught for the first time doing either 35 or 36 in a 30 and the area you are caught in is one where the courses are run.

You would not normally be offered it for a second offence or where you are caught in anything other than a 30 limit.

Different areas seem to apply the guidelines differently though

You can ask to see the photo from the video - they may say 'no' because as far as I understand they are not strictly obliged to show you .... most will though if you write expressing concern, etc that - for instance - there may have been close or following vehicles

I would imagine that once you have identified the driver they would offer the course anyway. They won't normally do that at NIP stage. If it isn't offered I would certainly ask as to not offer it would be treating you differently than in other areas of the country ....
