Speeding ticket
I spoke to mate today who got done last night at 46 in a 30( bloody fool) he went through all the questions to try to wriggle out of the ticket (hand held gun) and was told the calibration certificate is now available to view online, and only tested annually.
My mates girlfriend was offered the course, 38 in a 30..! I received an NIP through the post for the company car i drive, 37 in a 30. I have asked for some evidence to help identify the driver, photos not clear at all so will see what else that can provide...

1) True.
But many FPN offices will.
2) Under the Rules of Evidence, evidence must be served prior to attending court.
But a not guilty plea must be entered in order for the prosecution to adhere
to these rules
So, I take your point
3) Not necessarily and the onus is on the owner to provide details of who was driving
That is why NIP's must be served within 14 days (so you can remember)
Unless given verbally at the time of the offence
Or unless the offence relates to an "accident"

Check out pepipoo for more info...
pepi who ?
poo.
quite.
Central ticket offices are unlikely to alter their policies due to the mention of the word evidence
After all, it is evidence, which you have a right to see (arguably not at the NIP stage)
And the ethos behind this thinking is to provide evidence to avoid costs for unnecessary court cases
Don't believe everything you read on the internet

If they are accusing you of an offence then they should automatically provide you with the evidence rather than you having to request it and no matter what terminology you use, the evidence should be provided. I never understood why they recommend not using "proof" or "evidence". The reason they don't send the evidence is they assume you are guilty to begin with.
The problem with that pepipoo site is that they build up your hopes by telling you to ask for calibration certificates, training certificate etc but the simple fact is that you have to be pretty lucky to be able to avoid the offence and unless you know you weren't speeding why not just hold up your hands and say "fair enough you got me". With the number of cameras around, it's bound to happen someday.
I only asked for evidence on the 2nd NIP because it was a complete surprise to me and I wanted to know what section of the road they zapped me it at. I wasn't denying the speed I just wanted to know where the fockers were so I can avoid them in the future.
I've changed my driving habits since my two NIP in six weeks and now whenever a copper is behind me my speed will now drop to well below the speed limit. Hopefully it will annoy them when I am in a 30 zone.

2. No one has to take advice offered. Either on here or from experts elsewhere.
3.I think Pepipoo is quite matter of fact and does not build up false hope. It is useful to know how the system works.
4. You insinuate I am talking bollox yet "arguably" agree with comments I made.
5. I don't automatically beleive everything I read on the internet... most of it (like the second post on this thread) is bollocks!
[QUOTE=CiderBoy,Nov 1 2008, 09:37 PM] 1. A NIP is a notice of intended prosecution. It is not a notice of prosecution, hence there is no requirement to provide evidence.

1) I know what it is and the legalities surrounding NIP's. Clearly you don't.
Are you suggesting I'm wrong? Please do elaborate, as your previous posts are inconsistent. You state this as true and then suggest I don't know what I'm talking about.
If all of this is an effort to make yourselve look clever, I suggest you start again in another thread!
[QUOTE=GREGSTERWIZ,Nov 2 2008, 11:39 AM]2) Obviously
You are just making yourself look silly now (and doing a pretty good job I might add)
I have stated my case and covered the relevant issues
You clearly have a somewhat limited grasp of police procedures and policies and motoring law as has been demonstrated by your comments
I suggest if you have further questions relating to this matter then you search the Pepipoo site
I am sure all your questions will be answered
Although not necessarily accurately
And will lend themselves to your misjudged, misguided and uneducated interpretations
Best of luck
