She was cited for careless driving NOT reckless driving... I am assuming careless driving is a lessor offense??, and she was "coached" by the police to say she was fatigued NOT sleeping.
the difference between the 2 may be intent.

i'm no law student, lawyer, or anything resembling one who deals w/ laws.
still the word reckless implies some intent or deliberate effort, whereas careless implies neglect of proper action.

whether they carry different levels of judgement or penalty... *shrug* you've got me. both however clearly show improper behavior and fault, which is really what you want for insurance purposes.

PJK3, you're right. Reckless driving can be an arrestable offense. It's at least a court date. Where careless driving is usually only a ticket. There's a higher burden of proof on reckless driving, since it is classified as a misdemeanor and not just a simple moving violation like careless.

I just looked in KBB trade-in value for our S......drum roll...... $15,625, third party sale of $18,020 and retail of $20,750. And those prices are not including all the mods. My question is ...which price does the adjustor/insurance company use to determine if a car is totaled???
