No refund?

Default No refund?

Just an off the wall question. My wife bought me a cell phone case from one of the vendors that has a cart in the Florida Mall. She gave the correct model number and manufacturer. When she got home the case did not fit the phone so we went back to the mall to get the correct one. They did not have right one but we could not get a refund only a credit. The receipt had no refund and there was a sign by the register that stated no refunds. The question is since they sold me the wrong item and did not have the correct one can they still not refund my cash? It's not a money issue but they screwed me over issue. Do I have any legal recourse?

Unfortunatly they can do whatever they want. I think they should give you a full refund but they probably wont. I never buy from the kiosks for that reason. Crap products Crap service. Good luck.

if they have a sign then techincally they've secured their position.


However, rules are made for breaking or bending. It's their policy so they have the opportunity to make it right for you.

I suggest doing your best to calmly state your situation to the manager/owner. If they still don't feel compelled at that point ... mention that you will be authoring a letter that will be sent to mall management, the Better Business Bureau, and the cellular service provider that they are supporting.

Write a demand letter, cc it to the mall office, and contact the BBB. If you have an attorney, cc them as well.

That will do it.

I used to work at a Kiosk. As long as it is CLEARLY posted, you can only get credit... We had a cell-phone Kiosk next to ours (sandals), and they had people bitching left and right all the time... but its all legit.

How much did the case cost? $15-$20? Seems barely worth the effort to me unless your principles are getting the best of you.

Can they get the right one? If so, have them order it for you. The other option is to use the credit for some other accessory. I feel your pain, but it's always 'buyer beware'.

Thanks for all your responses but I will just chalk it to experience and another life lesson. Wife paid $30 for something you can get on Ebay for $10 but she did not know. I will just let it go. Merry Christmas to everyone.
