Thoughts on getting out of this traffic ticket....

I don't know all the details but it's an interesting story.

BUMP.... Updates:

I was originally given an Oct 8th court date, and was prepared to fight it this Monday. I got a statement from my insurance company stating I had never owned that vehicle, and had the photograph timestamped of when I was driving my Honda Fit.

Today I was rescheduled to Dec. 10 because the officer couldn't make the first date. This is really starting to drag out here.....

Do you think I could write a letter to the hearing officer pleading my case of innocence and not have to wait for this court date? Once I write such a letter, can they change the ticket information?

I contested a reckless driving ticket in IN for making a U-turn in a parking lot. I plead innocent in court, went to a side office and explained my story and they immediately offered a illegal lane change citation. I settled and saved 4 points and a couple hundred bucks but wasted half a day.

I also was pulled over for having an expired plate in IL, the cop immediately issued me a ticket. I asked if he ran the plate because I knew I had just renewed it and may have forgotten to put the new sticker on the plate. He said he ran it, it was expired and gave me a ticket. I drove a mile down the street to a currency exchange and had them run the plate and of course it was not expired. They told me everyone uses the same database. I then had to go to court and waste hours of my day in line to tell the judge "I don't understand how the officer can run a plate and it is expired, when 10 minutes later I run the plate through the same database and it is good." The Judge asked the cop if he ran the plate, the cop said "yes" the judge asked him if it came back expired, the cop said "yes". The Judge looked at my papers showing that it indeed was not expired minutes after being pulled over and dismissed the ticket. J@ckass cop lies to me, lies to the judge in court, then I prove it and nothing happens. Such a bullsh!t time waster.

Stick with it and fight it, I cannot see how this won't be thrown out. Fight the power. LOL

My wife's an attorney, and I just asked her to weigh in.

If you want to hire a traffic attorney, this should be very easy. Find a "ticket clinic" type firm that handles Polk county.

If you want to do it yourself, show up with copies of vehicle registrations for all cars you own. Maybe even a copy of a vehicle search from the state of FL website showing what VINs are registered to you. Be explicit that you do not own a white Chevy, and were not driving a white Chevy (yours or anyone else's) that day. Show them which car you were driving. Assuming you were in a different wite car with a completely different license plate, it sounds like a clear case of nabbing the wrong car. Show up well dressed, be polite (yes sir, no sir), and stay cool and controlled regardless of what is said. Talk only to the judge, not the cop. Do NOT interrupt anyone. Just answer the judges' questions when asked.

This whole thing sounds like a bad sequel to My Cousin Vinny.
