Actually, if you can, don't even involve your insurance company. Since it's entirely the other guy's fault, only speak to his insurance company, and have them deal with you.

Why? In a situation like this it's your insurance company's job to make certain the other company coughs up enough cash and doesn't try to get away with anything. They have a lot more pull with the opposing company than you do and a big legal team at their disposale. If the other guy doesn't have insurance, or does have some but they won't pay, then your company will cover it for you and use legal means to recover their expense from the other guy. You may have to pay the deductable at first, but they will recover that for you as well.

The reason is because when I switched insurance companies, I was charged more because of that accident I mentioned earlier with my Celica. It wasn't my fault but it put me at a higher risk category just because there are more accidents under my belt, regardless of fault.

companies have also have a "loss payout" report that they use to establish your risk and the amounts they've had to pay out, regardless if it was your fault or not.

it's one of those things that is not supposed to be shown to anyone, especially policy holders. at least that's my understanding. i've seen the report for my company and it records ALL payouts. i don't know what it would look like if they payout for taka's loss and then can't recover all the money.

but i can see mckay's point and i can also see why they would want you to get them involved...they can better guess if you put yourself at risk, unnecessarily.
