Ouch, if this happened in VA then you are also eligible for VA's new $3000 Civil fines in addition to the normal fines.

Definitely get legal counsel.

Also from now on when the trooper ask if you were speeding the simple answer is no because any excuse you give is an admission of guilt in court. You also may want to get a radar detector soon. It doesn't prevent tickets but it helps. Good Luck

radar detectors are illegal in VA which means he could've still gotten pulled over and gotten an additional ticket for the radar detector. I dont think recommending breaking more laws is going to help him.

Of course I have one along with other people on this board in VA. If you have a VG-2 CHIP its undetecable. He's fine if you use the radar to his advantage you can't haul @$$ with radar and not expect to get caught.

Let's get something clear. I'm not trying to have a battle with you on the internet. You took what I said the wrong way. Quite Frankly I sure we both have the same good intentions on helping someone else out in a bad situation. I'm not trying to mislead emerlin But a Radar can help In tight Situations. Now that I think about It Just about anything you throw on your car in VA besides wheels just about is illegal it seems.

Get a lawyer and if its your 1st offense you might be ok... But I got like 3 Reckless tickets before trust me its gonna hurt for a while, best thing is get a lawyer and tell him to try to get him to get the cop/commonwealth attorney to drop it to speeding

like others have mentioned, get a lawyer. usually a good lawyer will recommend you to do two things befreo court: take a driver improvement course before you go to court and get ur speed re calibrated.

good luck

You need a lawyer. The 20+MPH over the speed limit is a wreckless driving charge/allegation. It still has to be proven in court but the officer will be able to answer when his/her speedgun was last tested and/or when his/her speedometer (if he/she was following you for about 30 seconds) was last calibrated/tested.
1. He got stopped by a State Trooper. He has his radar calibrated before and after his shift. This is what they do for a living.

2. He got stopped on 66. He's in VA.

Now my question to you is this. Did he write you for SPEEDING or Reckless driving? The reason I ask this is because one is a prepayable offense and the other is a mandatory court appearance. It all depends on what code section he wrote you under.

Now if he wrote you for speeding, I'd prepay that and not show up in court because the charges can be amended in court to a reckless should you want to contest it. You're better off prepaying it and forgetting about it.

Now if you he wrote you for reckless, then you'll need an attorney. It is a class 1 misdemeanor and a jailable offense, not to mention the lovely civil penalties that just went into affect. If you need an attorney, pm me and I'll send to a friend of mine that I helped when I was with the police dept.

Now as for the recommendation to get a radar. Yea.. great advice. the guy is already in deep poop and you want to help him get into more deep crap. This isnt about seeing how you can get around the system, it's about what to do now that you are already in the system. I'm sure he's already learned to slow down after this summons.
