If it were a construction or pothole repair not marked, then yes, the city, county, state is liable. If it is just a pothole and hasn't been worked on, then I believe they are not liable. airgate won his case against someplace in NC based on the fact that the site was unmarked.
Hmm... well even if they are liable, i dont think they always pay. The case that I was referring to actually had a huge pothole that MANY cars were damaged by over the course of a few days. There were NO signs up and yet the insurance of the person who I was talking about wasn't able to have the DC government reimburse them for the payout they gave to my colleague.

Potholes are not covered, Naveed, unless they have been working on fixing them and left the site unmarked.

Yeah, I know which one you are talking about. I've driven by there and most cars see it coming and move out of the way, but I've heard a few cars hit it and it's the worst sound ever.

I don't think my friend is looking to get any money from anyone. She really doesn't care as long as she gets her car back up and running. Just trying to give a heads up.

Y?es, it was a hoorible sound to see one car after another slam into it. It was an unmarked construction zone and VERY unsafe. I was actually so worried that it would cause a more serious accident that I called the police and told them someone needs to mark that off. The police did come, but the cop just leaned against his car and watched more cars keep hitting it. I wasn't a fan oh that guy so I just gave up and left.
