i know in NH you can ask for a fix it ticket and they will usually let you do that. that is what i did when i got pulled over with my invidia while in nutral past the cop 
Also its 2 point in NH for getting ticketed for exhaust. dont know if its different in mass

I have to say, that at one point in my early driving career I was pulled over 13 times and didn't get a ticket. Most of them in my 1989 Red, Conquest TSI and my 944.
