Default Ticket need help

Hi All,

Driving today I got my first speeding ticket in 20 years. 85 in a 60.

I do not know the laws in MA.

What is?

1. 90/17 (mass penal code???)
2. Laser was used but ticket sais estimated?
3. The number 1066.2 is written on the ticket? What does it mean?


What is the procedure to fight this ticket. I moved to MA in 2000

90/17 is the speeding code, i believe.

If it says laser and Estimated that means he prolly tagged you at 65-70 but saw you braking hard, and estimated 85.

I'm in the process of fighting one myself...the asshole didnt put radar, lidar, or estimated. He forgot to check the box... hopefully I can get away with it.

Your ticket has an address to which you send the challenge. Do this and wait for a court date. Show up dressed nicely (you'll be surprised how some people dress to present their cases to the judge magistrate) and offer anything to challenge the accuracy of the reading. Was there other traffic, for example. 85 in a 60 sounds strange, most places here are either 55 or 65 these days. There should be a representative of the police department present, even if the issuing officer is not there.
90.17 Chapter 90 is the general law governing motor vehicles. I don't know what the 1066.2 means.
Possibilities now are that you will prevail in the challenge and have no record. Or you may have the speed reduced, reducing your fine. Worst case, you get the full fine. Then the insurance vampires dive on you for 5 or 7 years, because your perfect rating went from 9 (I've yet to meet anyone who understood why perfect was 9 and lesser ratings were higher) to some higher number.
The good news is that you won't loose your license for just speeding.

Actually,

I got my ticket on 8/18/04... and the cop/clerk or whoever entered it, entered it as 6/18/04.
I got a letter from the RMV saying my lic. was suspended for late payments!

I photocopied all the information, hopefully it helps my court case.

I'm fighting mine currently because of certain factors.


i know i was doing 45 and not 56.
My speedometer works fine.

Do some reading on the accuracy of radar guns, I did. And using it as my defense.
There are many errors a radar/lasar gun can get.

For instance they can't read around corners (My situation), they get their signal off a reflected source (I have no plate so it was my headlights, now we all know they flicker so I believe this could factor in an error), Also if the police are using the heater or A/C, this also throws off a reading (it was a foggy, cold night, when I was pulled over, I know i had my heat blasting, sure he did to). The police also have to follow a precdure before determining they are getting an accurate reading, they will also get a loud tone from their guns i read, and follow a 5 step checklist. I seriously doubt my officer had the time during our 2 sec hello around the corner.

Hello

I too got a ticket, on 84/tolland CT. I was following 2 other cars doing about 80 in 65. I was followed by a malibu, and as soon as the front 2 cars moved over to the middle lane he busted me before I myself got a chance to move over. He wrote me up for 85.

Any ideas on what I should say? I was going to say something about following traffic....

oh...my fine was $297. Does anyone know how they arrived at 297? why not 290 or 300, not that i want to pay more?
