Thats 2nd degree.
Its sort of like shooting a guy in the leg, trying to disable him for life, but not kill him, but the guy dies. Well you didn't intend to kill him, but you did. Thats murder.
Its when your actions go way beyond involuntary, but not quite (for the lack of better words) putting a gun to someones head.
You park a car infront of a train, you have to know something bad is going to happen.

While Im not sure if there is a law for it over here Spa I am sure that they'd cuff you if they caught you doing something like poking a tube fed from the exhaust in the window. I mean they could hardly stand around and watch.
Getting back to VoIPA's irony perhaps they should pass a law that attempting to commit suicide is punishable by death to prevent people from screwing it up and killng lots of innocent commuters instead
