ATC Priority, maintain seperation and prevent collision. If you travel from Cali to Florida, The pilot will have talked to more ATC then you would imagine. everything has to be considered while flying, for safety. Airspeed, altitude, heading,etc... There are also many different types of controlling (ex. radar and terminal) I work in a tower (terminal environment) everyday. People would be surprised how easy it is for pilots to F@#$ things up quick.

How bout that accident over Switzerland last year or two when a DHL 757 and Aeroflot jet collided while converging over a navigation point at 30,000 feet? That was ATC's fault, but pilots also didn't respond in time to the conflict resolution provided by TCAS....

Well, actually it was a Bashkir Airlines TU-154 that hit a DHL B-757 over Germany. Neither aircraft was fitted with TCAS.

The 757 was according to what I have read.....I think all 757s have it by default. They apparently didn't react in time. I will look for the documentation on that.
