Anyone get sued for something just dumb?
I was exiting a parking lot. The people in front of me proceeded to make the right turn out of the lot. I was behind them. Believing that the people in front of me moved on (they did) and then I started to look left for oncoming cars. No cars coming and I proceeded to go...
Then I got stopped by the bumper of the car in front of me who stopped suddenly. They were past the 45-degree point and there were NO CARS COMING. I think they saw in their mirror I was looking left and stopped on purpose, but I can't prove that. I was going less than 5mph.
My car had really just cosmetic damage...the hood, bumper, and a headlight were damaged. Their car had a dented chrome steel bumper. The estimate for the repair on their part was a max of $500 as they went to the same shop I did.
Later I find out they are suing me. I got served with papers from the passenger and I'm expecting them from the driver any day now. They claim all kinds of nervous system injuries and claim they have a loss of income.
My insurance believes they have no case and offered a grand sum of $1K to them
They are on their second lawyer now, probably because the first thought it wasn't worth the time. These people were NOT HURT (according to them) and were ambulatory. They did not see a need to call the police nor an ambulance.
Later I find they have sued multiple people, are both recovering alcoholics and at least one is a recovering coke addict. The driver later got into a bad accident when she was at Wal-Mart in the motorized cart (she's kinda big) and allowed herself to get hit by a car in the parking lot. So, hopefully she has no case with me. On the loss of income...they have not worked in years.
Anyway, I think their lawyer sucks. The summons had all kinds of punctuation problems as well as repeated sentences as well as liquid paper corrections. They allege I was on the phone and are asking for a bill. I gues they will be upset to know I only had one call that day and it was hours from the accident.
Anyway, USAA is being great about it and will represent me. It's their money as I have lots of insurance. It's sill annoying as it requires me to put the effort into getting a phone bill online, copying my license, and listing all the doctors I have used in the past five years. Good thing they only want the meds I've taken in the last 12 hours prior to the incident (ZERO) because my meds list is quite extensive with narcotics and all...too bad the lawyer in his infinite wisdom only wanted what I had 12 hours prior. One of his other questions asked if I had a cell phone available and in the car...the answer is NO because it wasn't in the car. All in all, I hope they have faith in their lawyer because I don't

Just let your insurance take care of it. Good luck with everything. Needless to say, I just hate people who try to extort others in these situations. At most, your insurance owes them for the bumper repair and that's it!
well they both have extensive health problems due to smoking, alcohol, and drug use. They claim the incident made them both worse.
They are also claiming disfigurement, which is strange. Then again, both got beaten with the ugly stick before so maybe they are trying to collect for that.
BTW, the passenger, the husband, is 62. The "trophy wife", the driver (note the "" in trophy) is 27. She's hardly a trophy as I honestly thought she was almost 50. She's THAT run down.

I wish there were a tort for that.
I personally think that if the court rules something frivolous the offending party must pay court costs as well as attorney fees for the other side. Of course the tort lawyers would have a fit because it would spell the end to their income source.
