Running probably has more of an impact on the spine than a <5MPH bump.

They're not the first person to try this and for sure wont be the last.

USAA will take care of you. It will be a basic sum offer to the lawyer - like $1000 - and the lawyer will take $500, and the other people will be happy with their $500 in the end.

Had a friend who was at fault, but almost got bent over by a greedy driver.

She was sitting at a red light her Jetta behind a mini van. The light turned just as my friend was reaching for her phone. She waited a second and went. The van had started then for some reason stopped. She hit her traveling at MOST 3-5mph. The driver of the van gets out limping and saying her knee hit the dash. They went to the freaking ER and hired a lawyer within 48 hours. A police officer drove by and noticed them exhanging info- he didn't even take a report because there was no visable damage (even paint with a white car and black van) to either vehicle.

Six weeks later, after my friend's insurance dealt with the lawyer, they told the victim she'd have to haul them into court to get any money. They discovered she had filed claims with the same injuries against three other people. They never filed suit and dropped it.

Most people/insurance will just settle for some figure instead of risking trial. That's usually the motivation for bogus stuff like this.

yeah, those guys sound like scammers. they probably purposely slammed on their brakes cuz they saw that you were close behind them and not paying attention. i hear stories about these kind of scammers all the time.

Sounds intentional.

I would not sweat it. If they show up in court looking like the personal trainwrecks that they are no judge will buy it. They see it all the time.

Don't lose sleep, they will take the $1000 eventually.

I was T-Boned when a woman failed to 1) Stop at her stop sign and 2) Clear the right of way.

Since I was alone and she had her daughter with her I was ticketed. Took it to court and proved I was not at fault.

State Farm also agreed with me and stated she was at fault for the accident and attempted to settle.

3 Months later I find myself in a court house being sued for the damages to her vehicle.

At the time of the accident she did not have a drivers license on her person. She did not know her date of birth. The name given did not match the name the plate/vehicle was registered to (She claimed it was her husband). Yet the Miami Dade Police Officer still gave me the ticket.

In court, my attorney provided by State Farm, pointed out that they could not sue me because they did not want to accept the offer by State Farm.

After the case was dismissed they hired an PI who discovered that they had pulled this before similar to what you are facing with.

She also claimed lost wages due to not having a car when she hadn't been employeed for over 3 years. The damages to the car was a head light a repainted bumper yet they were asking for 9k in auto repairs and over 6k in lost wages.

After further investigation both the woman and her "Husband" where charged with insurance fraud and he was reported to the INS because he was an illegal using an assumed name and stolen SS number.

So yes I have been sued for something dumb.
