A driver should be held accountable if they get into an accident while using a cell phone and/or participating in all other non-driving activities (eating, makeup, etc).

I can tell by the 9 to 9 vote that this is similar to talking about religion and politics. There are interesting comments. However, The VAST majority of people I see driving while talking are in another world and are somewhat of a danger to myself and others out there. I even got into it with my sister about her use. I know the type of person she is and keep waiting for a call that says "While I was talking to so and so on the phone, I didn't realize the light had just changed and WHAM". I'm just a bit concerned as to who is out there and if they are concentrated on the road.
To OhioRacer: You'll be there in no time. I hope you won't be on the phone when you hit VTEC. :-)

1. Do you believe in God?
2. Who was right in the Vietnam war?
P.S. If you change your mind, we are still getting together at 7PM.

if you're driving your car, then that's all you should be doing.
no talking on the phone.
no putting on your makeup
no shaving
no reading the morning paper.
no plucking your eyebrows (saw this once, scared the crap out of me

The last person that I saw driving and talking on a cell, cut across 2 lanes of traffic, and directly in front of me to make it into a left turn lane probably 50 yards ahead of us.
It's too easy to get deep into a conversation and forget what you are doing.
Don't ban cell phones.
IMO, it's not so much the act of talking on the phone that causes crashes, as it is the simple act of answering the phone. Even a hands-free set requires you to fumble with your phone; even more so a hand-held.
Anyway, I see no harm in making a quick call to your buddy behnid you to verify which movie theater you're going to, or to tell your mom that you'll be at her office in five minutes to take her out to lunch, or to (obviously) make an emergency call for you or for a fellow motorist. But when I'm in rush hour traffic in the fast lane of the freeway, following those stupid slow-driven H2s whose driver has been talking on the phone for the past 15 miles, I get really pissed. Firstly, he's slowing down the flow (you could fit 2 semis in front of him with room to spare), but moreover he's (probably) caught up so much in his conversation that he can't tell the difference between brake lights on the car in front of him or the signal light flashing on his dash for the past 10 miles. Really, it's beyond me.
Like many have already pointed out, the issue is much too broad to even attempt to regulate with a singular law.

Here's a minute thought to consider:
Maybe some of you who depend on cell phones (to the extent that you need to conduct business with them while driving) would have better lives without a cell phone. I'm not making any assumptions here... just stating that a little quiet time in the car before starting your day might leave you better mentally prepared for working. I don't understand this obsession we have for packing the maximum amount of information into every second of our existence.
I can see the usefulness of cell phones for emergency purposes and such, but I think for the most part they have not improved our lives. Just because the technology exists doesn't automatically mean we should use it.
