It's unclear exactly what happened next, but Martin said an argument between Payne and the seven police officers who attended the hearing apparently escalated to a scuffle, ending when an officer shot Payne from behind.
Another officer suffered a grazing wound to his finger from the bullet.
It's unclear if the officer has been disciplined.
Prosecutor Lindsey Fairley said Thursday that he didn't plan to file any felony charges against the officer or Payne. Fairley, reached at his home, said Payne could face a misdemeanor charge stemming from the scuffle, but that would be up to the city's judge. He said he didn't remember the name of the officer who fired the shot.

Interesting how people mold the story to make it sound more interesting. "The Fire Chief complained, so the cops shot him". Really, is that what happened? How about "The Fire Chief complained, there was a fight, the cops shot him"?
I'm not sating it was right or wrong, justified or unjustified, excessive or necessary. I don't know - I wasn't there and I don't have all the facts. But if you're going to criticize, at least try to get the story half right.

7 cops couldn't handle a 'scuffle' with one dude, so they shot him. better? my cliff notes were for irony only. sorry if you feel i was misrepresenting the article.

I had some friends in Downtown San Diego last week. I didn't go, but apparently, some guy robbed a store down there, injured a security guard (knife I think) and when the cops showed up, the cops shot him dead because he wouldn't stop moving toward them.
Granted, if a crazy is walking toward you with a knife, then by all means shoot him, but shoot to disable, not kill.
I think it's getting out of hand as well.

If you shoot someone, you shoot to stop. Was the deceased carrying a weapon with intent to use it? Did the cops tell him to stop? Answer is yes - that means the use of lethal force is authorized in just about every city and county in the US (well, maybe not Berkeley
).
