credit card dispute questions....

Default credit card dispute questions....

i haven't disputed anything for years. I bought a $2800 S2000 engine/tranny ecu combo from a place in NYC. It came with a 6 month warranty, but it was missing about $550 of vital parts. I was told verbally to go ahead and get the parts and they would credit my credit card...... then they said that was too much $ and they wouldn't....

The tranny then had a bad 2nd gear so i had it swapped and sent the old one back to NYC.

1 - does it have to be in writing when they told me to get the missing parts? I even had a trustworthy shop do the work who is backing me up completely on this stuff

2 - who pays for the labor to re-swap out the tranny's? It was about $500 and totally related to the bad tranny they sold me.

those are my 2 biggest questions. I thought there was a process in place to protect the consumer. from the sounds of it so far, they believe the seller and are basically f-u-c-k-i-n-g me.

Which card? I bought a desk and when it arrived not all parts where there. I spent months with the vendor trying to get it resolved. Finally I called AMEX and they contacted the vendor on my behalf. They told the vendor that if they didn't provide the parts, they would debit their account for the entire purchase. Parts arrived and everybody was happy. AMEX even sent me a potted plant thanking me for doing business with them. Ok, that part was just weird.

AMEX didn't care about their fine print, must be because you're a good AMEX customer, or maybe that just how they do business. I find the Mastercard and Visa would rather not get involved. I've only disputed two charges in my life, one was a deposit I had to put down on a car when I was stupid kid so that I could think about buying it. WTF was I thinking? I didn't even know the price of the car before I put the $100 deposit down. Second Sprint charged me for a phone but I had to beat them about the neck face and head to credit my account after I rejected the phone, it took three months before I received it and after about 2 weeks no one knew what happened to the order (it was never even in their system) so I told them to cancel the order and bought one on e-bay. Three months later I get a phone delivered and they charged me, rejected the package and then had to fight for a few days to get them to fix it.

I think if you have a Gold/Platinum card, you generally get 1-yr to lifetime support on ourchases. Also, if you are in good standing, the CC companies are more willing to help.

I've called my CC companies before to credit my card back when a product was not as expected without issues, but its always been in the first month or two. My companies have always been happy to help. If its not as expected upon arrival, I don't haggle, I just send it back and demand a refund.

I think you can get your money back for the purchase, but the labor charges for the swap are probably yours. You can also pursue the matter in NYC small claims court if you want to eat the travel and court costs and gamble on a counter suit.

i do have a gold visa or platinum...i think it is now platinum, but was gold when i charged the motor..... it has been under the 60 days that is required, so i was fine there.

I am pissed about the "you needed it in writing" shit when I was told on the phone to get the parts and they would pay.... and I am pissed about spending another $500 to swap out their broken transmission.....

When I do talk to the dispute dept i may have to ask for a manager or something...this sucks ass. 6 month warranty on my purchase didn't mean dick!
