Unemployed!
Well the Thursday before New YEars my boss comes in and tells me the company is letting me go. I had been there for 7 LONG years. The past 5 years I wasnt happy there and things werent getting any better. I should had left that company so long ago but I kept on keeping on there. So its bitter sweet. However, now Im put in the position to where I have to look for a new job and file for unemployment. I know there are some stipulations as to if you get unemployment or not and for each state I guess the reasons can vary. Im trying to figure out what my chances are of qualifying for it. Being that I got fired and the reason is kind of my fault and theirs I am kinda freaking the heck out. The previous years working at my company they let me work pretty much my own hours and even if I was sick I never missed a day. But I would come in between 9:10 and 9:20 every day for the past 5 years. Occasionally at random times during those past 5 years I would get a write up (a grand total of 2) or an occasional verbal warning (no more than 3) for me coming in later than 9am. However in the past they even acknowledged they let me work my own hours. And not one time out of the past 5 years did any downtime in production or anything else resulted from the times I came in. If there was something I NEEDED to be there early for I would be early. In the state of NC, you qualify if you were fired for something that wasnt of fault of your own. Now while Im sure coming in late every day is pretty much my own damn fault but it WAS something they had no problem with and as you can tell they had no problem with it because they let me do it for 5 years. So could that be a plausible argument? I am a hard worker and dedicated to the work I do, my coming in late was a result of some bad business they dealt to me. If anyone needs some freelance designing done let me know... I can use the cash right now!
Simple, you had a verbal agreement with your employer that you could set your own hours. Simply tell the folks at the unemployment office that you were "let go / laid off", for the reason put unreconcilable differences / laid off, they will send a letter to your employer to show up at a hearing at an early time like 7:00 am which they will probably not do, then you will get the check in the mail. No sweat, just always stick to the we had a verbal agreement to set my own hours argument and never ever back down from it, or else you'll get hosed.
We fight our unemployement claims if the person got fired. we don't care what time the hearing is, we'll be there or a representative for our company will be there. I am not in Human Resources, but i do know we fight....

get a lawyer that does unemployment, present your situation, any text you got. maybe attend the heraring your self or with the lawyer but at least hear the buzzz words you need to say. know your start/stop dates and your pay rates, copies of any reviews. a copy of any official notice of improvements etc. go through your mind when you discussed personel issues with your company

It must be differant in the US, why would you employer care if you go on UI?
Our is government funded, if you lose your job for any reason, and assuming you paid taxes while you were working for a min. amount of time you get UI.
The company you worked for has nothing to do with it. Does the company that canned you have to pay?

Ours is federally funded, a small portion of each paycheck goes to it, however the company also has to pay a small portion as well. Their rates go up, so yes they have to pay more if you file. However in general most employers don't bother because if they screw up you can sue the living daylights out of them. That's why my advise is what it is. For an employer to open the door to a law suit over such a small increase is trully stupid. Any good laywer would soak any company deniying nearly any claim of UEI. I don't care if you killed somone on the job, it isn't worth the time, effort or risk for an employer to fight it. As the employee all you have to do is never say you did something wrong. In this case i hope he didn't sign the write-ups. Never ever sign something like that. If they are writting you up then they are looking for evidence so that they can fire you, if that's the case make them fire you without the write up then they don't have a leg to stand on, or sign it and put your resume out there ASAP, better to look for a job while you still have one then later, tougher to get one if you don't.

525 a week here in Jersey, and being that im union I also get 250 a week on top of my unemployment from my union hall. I dont have to seek a job, since that is what my union hall does for me. Ill be unemployed for 2-4 months and make good money still.
yea, NJ unemployment is sick. You can live on that.
In FL, if I remember from the 2 months I spent on it, is $275 a week, assuming that you made enough money ($40K I think was the max wage base).
