Do I really deserve this?

Actually it IS the officers choice to make.

Officer discretion can be a good OR bad thing. In this case, being towards the end of the month... He just chose to be an ass about it.
My comment was for the OP and the one defending his position. I agree it's the Officer's choice to make. We are saying the same thing.

To the OP, you can fight the ticket just like you can fight a speeding ticket. Sometimes you can get away with it, sometimes you get caught. You got caught.

You are asking if you deserve it, the answer IMO is yes.

Just because you can do it a 100 times and never create an accident, what about the 1 time someone who is patiently waiting to move left turns out and hits you because they don't expect traffic coming up the center divide from so far back?

It will be your fault.

Pay your ticket.

So, OP, where are you located? Here's the only relevant statute I could find for Texas:

Doesn't look like you broke that law.
"(1) if passing another vehicle and the center lane is clear of traffic within a safe distance;

WTF...I didn't know you could do that.

Not really. Cars have rearview mirrors. If someone doesn't use one and just whips out in front of you, it's their fault. I'm sure he wasn't going 90 in that lane.

More like 15 or 20mph - slowing inching toward the turning point.

Where do you live? In California you can drive in the center lane for up to 200 feet. Go find out what the law is in your state.
