Regardless, even though people are stupid and buy things that say "picture" only, I still feels its a scam because the person bought it on the assumption of something else. It may say picture only but it was probably in some stupid little spot somewhere hard to read or worded to it was hard to pick up on. Thats a scam in my book...

Aside from the obvious, who the hell would spend 400 dollars on pictures, the auction said the item weighted xxx ounces. A peice of paper does not weight that so thats misrepresentation already which is all the lady needed to file suit despite it saying it was a picture only.

maybe it was unethical, but a scam? it really isn't the defendent's fault that the plaintiff was careless. sure, she took advantage of it, but people do that shit every day. corporations, the government, they ALL do the same shit.

Its definatly unethical and (IMO atleast) a scam but I guess that depends on how you look at it
