If she put in big words near the top of the ad, "Photos only!", then it should be the buyer's fault for being stupid and not reading. If she hid those words in some inconspicuous place, then she should be killed. Either way, she's not moral, but with the former, she's not 100% at fault.

Regarding the daughter, she should do $$$$$$.

 

That was farcical. While I believe the girl's intent was to defraud, the personal attack made by "Judge" Judy would not happen in a regular court of law. You don't make personal attacks in that way, nor do you threaten constantly. A judge has a lot of power but a harangue like she went on would probably give grounds for mistrial on appeal (especially prior to actual sentencing/delivery of a verdict).

Secondly, the "scammer" didn't have to pay a cent. On that show, the court pays all costs (including damages). People are paid to take their case before that court and their cost to attend (hotels/food/transportation) is also paid. The "pot" is $5000. The party that "wins" the case gets their damages from that pot, then whatever is left over is split between both parties of the lawsuit.

You can't lose, except for the potential embarassment.
