Default Legal issue... anyone with knowledge?

So I let a friend of a friend drive my car last night. While backing up (nobody who is not an 2sk owner knows how to back up this kind of car), het swiped a barrier on the pass. side. Damage- broken JDM sidemarker, crimped/chipped fender, scuffed comptech sideskirt, and a nice door ding. Damage isnt bad, but is going to cost (i would guess about $1000-$1500). Needs a fender/paint, door work, JDM marker, and a new set of OEM black chrome emblems(cause the fender needs replaced). I heard the noise and knew it was my car, and 3 others watched/heard it happen. With that being said, how do I go about getting this guy to pay for it? The usual "I didnt do that" was said by him, though the car was mint, and put on the road 6 days prior. I am waiting on an estimate right now via fax. Police report? I dont want my rates/surcharge to go up if I file a claim-its high enough as it is...

I know I shouldnt let anyone drive(im sure some of you remember the New years Story of when i let my friend drive that car 45 minutes after I got it...he totaled it), and all the other things some might say. I dont need to hear it. I'm pissed at my self to the maximum this time and will learn the real hard way. Put yourself in my shoes here. All im asking for is a little help and do not need the chastising from some that love to so on this site(you know who you are). Just a little help would be good... from a mature crowd. thanks guys

well, if the guy was willing to own up to his mistake and pay up, then you could do it all under the table and your insurance company wouldn't need to know. but since this guy is not owning up to what he did, you've got to do it by the book: contact your insurance company, and the police.

First of all, he is not your friend. If he was, he would have the balls to own up to what he did.

Because he had your permission to drive your car, your insurance will pick it up.

The moral thing would be your friend to pay it obviously. From the insurance side they will do anything possible to not pay for what your friend did because well, he's not covered under the plan. I think, I repeat I THINK, that llegally you're the one responsible still.

If it comes out that your insurance pays for it, perhaps you can sue him to reimburse the cost. Tell him you'll sue, maybe that'll convince to own up to it.

It should be taken care of soon... He didnt realize the damage done... It looks like it might be good

EDIT: I am glad my face doesnt look like that again

He let another one of his friends drive his s2000 when he just bought it and the dude drove it into a tree, LOL. He was in the passenger seat and thats why his face was focked up.

Sorry yo....but you sound clueless......

He was YOUR friend alright..... cause you let him drive your car...
But he obviously didn't consider you HIS friend cause he left you hanging.

I wasn't there and I don't know the story but Sorry man....your nieve...

Please take that as constructive criticism. Knowing that murphy's law rides your back you best start taking deep breaths and THINKING about some of the decisions you make BEFORE you make them.

Stuff like this between friends is messy....even when it's a close friend.

Eitherway, your insurance should cover the cost. Make the police report, file the claim, pay your deductable and negotiate with that guy (wouldn't call him your friend) to pay your deductable at least.

Your original post states: 3 others watched/heard it happen. you have witnesses to the accident, so file your claim against him.
