My boss smokes in the office
my old boss use to do that. But the bad thing was that it was a one room office and he smoked Winstons. If you never smelled that brand, it was the worse smell, out of all the bands. I quit because of it. It was totally nasty. I would go home smelling like i went to a club.

you'll probably only make your own life difficult if you try to sue him for pain and suffering, esp. if you don't have a track record of trying to get him to stop, or of him threatening to fire anyone who tries to make him stop smoking in the office (or other infractions to that effect)
Richard, I remember stories of how hard your boss is to work for so I'm not shocked that you're leaving. My advice would be to just leave and also to give at least a full two weeks notice. While you may not owe it to him to keep your mouth shut and give a full notice you owe it to yourself. When I was hiring people all over the country for the company I worked for and found out that the person I might be hiring had sued their boss or company, they were very rarely hired. If they had a very good reason it wasn't a problem but if it was a fairly minor thing and I had another candidate that was equal I would hire the other person. The same would go for people who gave a minimum of two weeks notice. The person that just quit was not as likely to be hired as the one who gave notice. In other words, weigh the future consequences before acting.
