I've decided to leave my job (due to various reasons).

However, one thing that irks me the most is that he smokes in the office. Everyone can smell it, and on some days I get real nauseated from the smoke.

Should I sue him? Call the fire dept.? Call the cops? Or just do nothing and leave?

If you've got some health problems as a result of his smoking, sue his ass! However, there would need to be indications that you have had asked him to stop but he didn't.

 

are you sure? i think smoking inside the office is illegal in CA - so even if no one spoke to him about it, we can still sue, right?

I know how you totally feel. I hate the smell of smoke, never done it, don't even want to try it. But my boss smokes Cigars in the office. I'm ok mostly since he isn't always in and his office is WAYYYYYYYY down the hall. But when he's in the office and starts to huff and puff OMG i just have to hold my nose and breath as little as possible. It's the worst!

 

figure out a way to make the sprinkler system in his office go off when he's smoking. That woudl be hilarious and good revenge.

 

I'm sure you could. But you'd have a better case had you asked him to stop yet he refused to do so. Go talk to a lawyer!

it is illeagal in cali, unless it is a sole-proprietorship and all employees are family members. go figure. assuming you're not related to your boss, you can complain to many government agencies and make him stop. If you cant prove that his smoking in the office has harmed you, i dont think you'll get a cent.
