Default Need help! Ebay fraud

I recently bought a pair of Oakely's sunglasses for $40. In the listing, the seller says it's authentic and guaranteed real. But when I received it today, it's FAKE! It's so obvious that it's ridiculous. It's got Oakley's logo and trademark on the sunglasses. And you can find sunglasses at Safeways that have better built-quality. I paid for it via pay-pal.

What do I do? Am I screwed? The seller has over 10 positive ratings and none negative, so I thought I was able to trust him/her. If I tell ebay about this, are they going to believe me since the seller hasn't had any bad rating?

Please help!!!

Also if you paid through paypal and used the insurance, you can request your $$ back on it. Dont wait, you only have 30 days to file a claim.

Definately leave negative feedback though!!

You get what you pay for. The only thing that may have been authentic is the label. $40 for OAKLEY's get real.

Send an e-mail and photo to Oakley. They can push charges for violation copywrite infringement. Also since they were mailed to you you can file with the Postmaster Geneneral for mail fraud. This is a federal offense. Just a matter of how far you want to take it for $40

Really all the fake Oakleys I have seen do have the Oakley on the front but its like a lil scratched out.. Here in WA we call em Foakleys...Bolexes to are a popular item.

For $40, a lower inexpensive model from Oakley's would make sense (ie frog skins or any other ones costing brand new for about $60). If the glasses you bought typically retailed for over $100, you should know well they are fake.

A while back, I bought a fake pair of Oakley's for $8 shipped from eBay. When it arrived I thought it looked pretty cool, but a week later I ended up snapping one part of the frame. Oh well.

Exact same thing happened to me:

Here's what happened. I paid about $90 with a pic of them off of ebay. After paying via paypal and getting the glasses, they didn't feel right. So I went to the local store and verified that they were not genuine. So I emailed the guy and he said it wasn't his problem. Luckily, he was a stupid college kid. I called the campus police and they weren't too concerned.

So I reverse looked up his email on the Kansas State University system and got his number. I called him where we was pretty shocked. After a quick google.com of his hometown, and got his parents number. I called him back and told him if I should call his parents and gave him his number.

So he finally said if I shipped it back, he would refund my money. I ofcourse told him that my lawyer advised me to proceed legally (always a fun way to scare dumb college kids). He sent me back my money via paypal with shipping, for me to send them back and the cost for me to ship them to me.

The internet is amazing, see what you can do and scare the hell out of them. It's probably a dumb kid, no one is going to want to ruin their ebay creditablitity off of $40.

I've been scammed on ebay one time; it was for a $20 AMD Duron 700. Never got it. Another time I wasn't getting my 12" Chewbacca figure. The guy wouldn't email back. I found his info and called him. Turned out he broke up with his boyfriend or something and figured he was too sad to ship it. Basically I told him that losing a loved one is nothing like losing two of your organs (like me) and I still have the sense to ship out my stuff. When I threatened charges he shipped it right over

Wow. Something quite amazing happened!

I emailed the guy and nicely explained to him that I found out the pair of sunglasses are not authentic. This morning, I got an email from him; he already refunded my payment + shipping. He even told me to just keep the sunglasses (not that I'll have any use of them). He was pretty responsible.

BTW, the Oakely I bought was the "Jacket" that Michael Jordan wore back in the late '90's. I think they stopped making them back in 2000 or 2001. I had monitored ebay for a while, and they're now usually sold for $35~$50. I had a pair that was 4 years old, but broke its arm recently. I actually just bought a new pair of Juliet's, but wanted to buy the "Jacket" just for collection.
