Need help with getting my money back
all. I was hoping you guys might be able to help me out here. I'm planning to go to my bank after work and discuss this with them, but I'd like to know what you guys think.
I purchased tickets to a new year's eve party at Olive Garden in Times Square, New York. Long story short, my grandma is on a life support system and will be passing away soon, so I am not going to New York.
I called the restaurant in New York and spoke to the manager and they told me there was no refund and that I would have to sell the tickets on my own (which is something I was expecting). The issue is that I haven't received my tickets yet, and they cashed my $520.00 check on November 30th. The manager looked at the reservations and says that they never received my check.
At this point I was furious. I logged onto my wamu.com account and my check is there with a scanned image of it from when it was cashed on 11/30.

Should've used a better escrow service.

The bank can recover the funds if you talk to them. Then again. It's a lot easier to put a stop payment prior to them cashing it though. If you fax or email Olive Garden a copy of the cashed check, they really can't dispute it.

Check out the expers on www.civiltree.com. A nice/comprehensive site where you can file a small claims nationwide and recover your money.

the bank should have an affidavit you can fill out. They will try the best they can to get you the money back. One thing to remember, is that you never used the service they "provided"... go to the bank! the sooner the better!
