Need help with Legal concern regarding a car
as long as this guy is not a credit runner. i think u ll be fine. u just need to fill out some paperwork and make some calls.
also, u should not even give him the 500 dollars. tell ur lawyer u agreed to letting have the 500 because you were afraid he would take it all. he owes u 5000 with interest.
the real question is, why are u messing around with a mini!

the guy said, "he'll send me the money when he retrieves the funds". apparently, he decided to spend the money before the deal was finalized and is waiting on selling another vehicle.
this guy is a real douche bag because hes actually the one that decided to not sell me the car and changed his terms regarding payment options.

You are obviously getting screwed. Get a Lawyer. This is way beyond you calling him.
I do have a comment though. Why the hell would you buy a s2000 from NY if you live in Texas. This isn't a rare exotic that you are buying from a high end dealership. This guy probably runs a small "dealership" on the street corner or just online. You couldn't find a S2000 in Texas? I would NEVER, repeat NEVER do online business with a NYC area retailer. This includes - cameras, audio equipement etc. They are rude, not customer service orientated, and quite shady. Unfortunately, you are learning the hard way. Sorry for your bad luck.

Business law 101 tells you that to form a binding contract you need to exchange "consideration" or something of value or it is not binding. In other words, for a dealer to hold something for you and form a contract you need to make a deposit, but you do not need to send thousands of dollars.
If someone wants more than $500, I'd walk away. $500 show you are serious and you should not send more than you are willing to lose.
I dated a pshycho chick in college who went to see a civic that was being sold by some shady dude, who was selling the car for someone else. Psycho chick goes and drives the car and likes it but wants to have it checked out by a mechanic, and shady dude says I want $2000 deposit. So she stupidly writes this guy a check. Shady dude says car has never been in an accident. She takes it to mehcanic who says "Car has been in a serious accident, many many problems." She wants money back and gets zero.
Psycho chick goes to court, owner of car says, "Yes it has been in accident, I told shady dude this." So obvious shady dude is a liar. Lazy ass judge finds that even though the guy lied and does not own the car he can keep $1000 for the HOUR he spent with Psycho chick on test drive and has to give back the other $1000. He never does. Psycho chick is out $2000. ONLY SEND WHAT YOU ARE WILLING TO RISK. Even if you win, they leave it up to you to collect in small claims court in most states. Just because judge says "Give it back" does not mean they will.
And yes she was very stupid, but a college gymnast and very flexible so what the heck. You'd have gone out with her too.
