You are obviously getting screwed. Get a Lawyer. This is way beyond you calling him.

I do have a comment though. Why the hell would you buy a s2000 from NY if you live in Texas. This isn't a rare exotic that you are buying from a high end dealership. This guy probably runs a small "dealership" on the street corner or just online. You couldn't find a S2000 in Texas? I would NEVER, repeat NEVER do online business with a NYC area retailer. This includes - cameras, audio equipement etc. They are rude, not customer service orientated, and quite shady. Unfortunately, you are learning the hard way. Sorry for your bad luck.
Unfortunately, he's right. Lots of NYC retailers are ready to scam as much as you are willing to give. I hope you get your money back ASAP.

[QUOTE=vader1,Apr 10 2007, 02:02 PM] Business law 101 tells you that to form a binding contract you need to exchange "consideration" or something of value or it is not binding.

You need to contact the state and report him since he is a "licensed" dealer. I'm using the term licensed loosely as I don't know what is required in the state of New York to become a dealer. In Texas you must be bonded and there is a ton of paper work to fill out. It is not an easy process. When my sister had problems with a mechanic shop, she called the state and an investigator was on it. Needless to say, the mechanic was scared shitless and obliged to our demand. I hope you get this sorted out.

P.S. - You are being way too nice. Demand all 5500 back and tell him nobody ****s with my money.

Go after him hard with a lawyer. Make him pay what he stole, plus for wasting your time, plus for your lawyer fees.
