This thread is funny. Here in the "Golden State" the laws are all to protect the tenant. I may not have it exact, but I believe the landlord has to give a written 30 day notice to move out, if it's month-to-month and no lease. (If there's a lease, look at the terms) After 30 days, if the tenant hasn't moved, then you go to court to get an eviction notice. That takes a while. After that is served on the tenant, they have more time to actually clear out. If they file bankruptcy, that delays the whole process.
In the end, it can take six months to get rid of a tenant, and the whole time they aren't paying a dime of rent. I advise clients, to get the job done, (where they want them out quick) to offer the tenant a sum of cash to get out, payable when the place is empty, not torn up, and the keys are handed over.

she has to live under the terms of her lease too, right? document and record all of her violations (in video if you can) and send them to the actual owner. When the owner comes to her and she mentions your single unproveable violation, she'll be the one to leave.

Well, we have been documenting everything, but we have no desire to stay here. Today we got an "eviction notice", which was really just a piece of paper that was hand-written by her saying that we had until tonight at 10pm to move or she was going to call the police. I thanked her for the written notice, and informed her of the actual law which says we have three days from tomorrow to leave. She then went into a tirade full of expletives. I just laughed at her, and said that I felt sorry for her. I then calmly told her about the actual law and the fact that I had already talked to the sheriffs department about it. She seemed confused about what the real law says, so I handed her a copy of the Colorado Tenants Rights. She walked away after that.
