Maybe it's the fact that I have WAY TOO many friends who are lawyers, maybe it's the fact that I've scanned too many NDAs the last couple of years, maybe it's the fact that I completely understand that LEGAL and COMMON SENSE are NOT the same things. . .

I found the issue right away (in the Wiki):
McDonald's 3-ring binder stated that the coffee be served at between 180-190F.

Common sense is "established" when "common practice" is discovered to yield a serving temperature of at most 140F.

There it is, plain as day. If it were just a matter of coffee being coffee with nothing in the 3-ring binder, then you could hem and haw. However, it's in the binder, it's practice.

Honestly (per the Wiki), the fault is McDonald's for not settling the $11K in damages. Morons with balls.

there are danger in everything. Use common sense to avoid hurting/killing yourself. Including handle hot beverage with care.

You can't sue against acts of nature. However, what you can do (check with your attorney before attempting this) is find something you've been consuming for years, that has no known warnings or caveats, but has been altering your body's pH.

Then, by all means, sue, and collect.

All I ask in return is a steak dinner, knowing full well that consumption of red meat in excess may be harmful to me.

Well, I was being a bit sarcastic. Personally I think if a beverage is hot enough to cause third degree burns on contact with your skin... it's a bit too hot...
