question about restaurants
One of my business neighbors runs a pizza delivery biz.
he asked me this question which I don't have an answer for.
background: he's an immigrant who speaks little English and know little about laws.
a while back he refunded some customer's money because they claimed food poisoning. a few days later, they ordered again and again he refunded their money.
yesterday, when they order the third time - to the same address as the previous two - he refused. They threatened to call "the government" on him (he was not specific, I guess due to lack of good English/law). he relented and delivered. I suspect they'll call to demand a refund today.
I told him it is within his right to refuse service and googled and it seem the law is on his side. Does anyone here know if he's wrong for refusing service?
he's just an honest hardworking guy trying to earn a living. I'd hate to see him get taken advantage of or get in trouble.

He can absolutely refuse service. He can also refuse to refund them this time around.
This is coming from a non-lawyer but my buddy was a restaurant GM and dealt with people like the scammers here allll the time.

One woman... and I was in the restaurant for this... ordered 3 or 4 different things on the menu, ate half of each, and kept sending them back. Too salty, cold, whatever
When she tried to send the last one back my friend told her she had to pay for at least ONE of the meals she ordered. She got very pissy then finally admitted she didn't have any money on her.
well... obviously you had no intention of paying for anything in the first place, scamming whore. He threatened to call the cops at this point I think... She ended up going to get cash while my buddy held onto her purse as collateral or something.

Well, simple question. does your neighbor have a business license and is he legal? Is he in this country legally? If yes and yes than he is
to refuse service if not than he better be bending over backwards as someone eventually is gonna get him into deep doo doo.

Tell him to document what has happened, so it case they do happen to call and complain to someone (health dept, building inspector, whatever) he'll have something to support his side of the story.
